Sales terms
These sales terms apply to purchases of the Action Pack on lepinguluup.ee.
Seller and application of these terms
The Action Pack is sold by Klapib O脺, registry code 17554599, address Juhkentali 8, 10132 Tallinn, email info@lepinguluup.ee.
These sales terms apply to purchases of the Action Pack on lepinguluup.ee. Use of the free first-step check is governed by Lepinguluup's Terms of use.
What the Action Pack contains
The Action Pack is a one-off digital content and service package, generated automatically from the results of your contract check. The pack may include:
- a fuller explanation of each finding and suggested questions for your employer;
- a draft letter to your employer, with references to the relevant statutory provisions;
- a prioritised action plan;
- a case summary for consulting a lawyer, trade union, or an Estonian Labour Inspectorate adviser;
- where relevant, a request to check the wage calculation;
- supporting material for preparing an application to the labour dispute committee.
The actual content of the pack depends on what the free check finds. If the report contains no findings on which to base an Action Pack, the purchase option is not offered.
Legal information and the limits of an automated service
The Action Pack contains legal information, not personalised legal advice. It is generated automatically from the data you enter and the results of your contract check. It does not create a lawyer-client relationship and does not substitute for the assessment of a lawyer, a trade union, the Labour Inspectorate, or a court.
The service may miss a term, misinterpret it, or classify it incorrectly. Letters and other documents are drafts, which you must review and adapt to your own situation before sending. Klapib O脺 does not guarantee that your employer will agree or a particular outcome in negotiation or a dispute. This limitation does not reduce your statutory consumer rights where the digital content or service does not conform to the contract.
Technical requirements and use
The Action Pack is displayed in your browser and can be downloaded as a PDF file. Use requires an internet connection, an up-to-date browser, and software able to open a PDF file. No digital rights management (DRM) is applied to the digital content.
The Action Pack is displayed in your browser as soon as payment is confirmed and is also sent as a PDF file to the email address you provide. The purchase confirmation, with a reference to the sales terms in effect at the time of purchase, is sent to the same address.
Price
The Action Pack's one-off final price is the amount shown at purchase. The price includes all applicable taxes. There is no recurring charge, subscription, or delivery cost.
Klapib O脺 may change the price in the future, but a change does not affect a contract already concluded. The price shown when you confirm the order applies to your purchase.
Placing an order and conclusion of the contract
To buy, you enter an email address for the purchase confirmation, review the sales terms and the privacy notice, give separate consent to immediate performance, and press the buy button, which clearly states the payment obligation. You are then redirected to the Montonio payment environment.
The sales contract is concluded when Montonio confirms that payment has succeeded. Klapib O脺 sends you the purchase confirmation on a durable medium.
Payment
Payments are intermediated by Montonio. The payment methods available at the time of purchase are shown at checkout. Montonio and your chosen payment service provider process payment data under their own terms and privacy notices.
Klapib O脺 does not receive or store your card security details or online-banking login credentials. Klapib O脺 receives the transaction data needed to confirm the order, provide the service, and account for the payment.
Delivery of the Action Pack
The Action Pack is generated and made available immediately after payment is confirmed. It is displayed in your browser and can be downloaded as a PDF file. If payment succeeded but the Action Pack is not displayed or the download does not work, write to info@lepinguluup.ee and include your payment reference.
If Klapib O脺 cannot deliver the Action Pack because of a technical fault and cannot fix the fault within a reasonable time, the amount paid is refunded.
Right of withdrawal and immediate performance
A consumer generally has the right to withdraw from a contract concluded by means of distance communication within 14 days.
The Action Pack involves both the supply of digital content and the performance of an automated service. To receive the pack immediately, the consumer expressly asks that performance of the service and delivery of the digital content begin before the end of the 14-day withdrawal period.
Before purchase, the consumer separately confirms that they are aware that:
- for the digital content, they lose the right of withdrawal once delivery of that content has begun with their prior express consent and they have been given the acknowledgement required by law;
- for the service element, they lose the right of withdrawal once the service has been fully performed, where performance began with their prior express consent and they acknowledged the loss of the right of withdrawal.
If the consumer does not give the immediate-performance consent and acknowledgement, the Action Pack cannot be ordered immediately through this checkout flow.
Loss of the right of withdrawal does not limit the consumer's rights in a situation where the Action Pack is not delivered or does not conform to the contract.
Non-conformity with the contract
The Action Pack must match the description given at purchase and be made available to the user in the agreed manner. If the pack is not delivered, the PDF file does not open, or the service otherwise does not conform to the contract, the consumer may request that the problem be fixed free of charge or that the pack be delivered again.
If fixing the problem is not possible, is not done within a reasonable time, or another ground provided by law applies, the consumer may use the remedies available under the law, including requesting a price reduction or termination of the contract and a refund.
No limitation of liability in these terms excludes the consumer's mandatory statutory rights.
Complaints
A complaint may be sent to info@lepinguluup.ee. Please include your name, contact details, purchase date, payment reference, a description of the problem, and the resolution you are seeking.
Klapib O脺 acknowledges receipt of a written complaint and responds to it in writing within 15 days. If the complaint cannot be resolved within that time, Klapib O脺 explains the reason for the delay and states a new reasonable deadline.
Dispute resolution
We try to resolve disputes by agreement. If the consumer and Klapib O脺 do not reach a resolution, the consumer may contact the Consumer Disputes Committee operating at the Consumer Protection and Technical Regulatory Authority: https://www.ttja.ee/tarbijavaidluste-komisjon.
The consumer also has the right to go to court.
Use of the materials
The buyer may use the Action Pack materials for their own personal purpose relating to their employment contract, and may share them with their employer, a lawyer, a trade union, the Labour Inspectorate, or a body resolving the dispute. Reselling the materials or offering them as an independent legal service is not permitted.
Governing law
The sales contract is governed by Estonian law. This choice of governing law does not deprive the consumer of protection that cannot be derogated from by agreement under the law otherwise applicable to them.
Version of these terms
The sales terms in effect when the order is placed apply to the purchase. Klapib O脺 sends them to the user's email address together with the purchase confirmation, on a durable medium. Later changes do not affect a contract already concluded.
